Privacy contact: Joaquim Silva, joaquimsilva@digitalcontrol.pt. This contact is not a designation as a Data Protection Officer.

Scope and law

This policy covers website browsing and enquiries by form, email or telephone. Regulation (EU) 2016/679 (GDPR), Portuguese Law 58/2019 and, where applicable, Law 41/2004 apply, as amended.

Data collected

The form collects name, email, optional telephone and message. Subsequent correspondence may contain project or service details. Server logs may include IP address, date and time, requested address, browser information and security or error events. Please do not send passwords, health data or other sensitive information.

Purposes and legal bases

Enquiries concerning quotations, steps requested before a contract and contracts with the individual rely on GDPR Article 6(1)(b). General enquiries, communications with business representatives and abuse prevention rely on our legitimate interests in communication and security, balanced against individuals’ rights, under Article 6(1)(f). Statutory duties rely on Article 6(1)(c). Any additional purpose requiring consent will be explained separately; submitting an enquiry does not subscribe you to marketing.

Required information and delivery

Name, email and message are required to submit and handle the enquiry; telephone is optional. The server sends the message to the company’s mailbox using SMTP. The form does not use the visitor’s email application or create a user account.

Retention

Correspondence is retained while needed to answer and follow up the request and complete the requested steps. Criteria include an ongoing request or relationship, statutory duties and the need to establish, exercise or defend legal claims within applicable time limits. Tax and accounting documents are retained for the applicable statutory period. Technical logs are retained only as necessary for security and incident diagnosis. Contact us for the period applicable to your specific case.

Recipients and location

Authorised staff and hosting, email and technical support providers may access data as necessary for their tasks, subject to confidentiality and, when acting as processors, GDPR Article 28 requirements. The company’s hosting and email services are located in the European Union. Data may be disclosed to authorities where required by law. We do not sell personal data.

International transfers

The form and hosting are not intended to transfer data outside the European Economic Area. Any service change involving such transfers must rely on an adequacy decision or another valid GDPR Chapter V safeguard, with information about those safeguards and how to obtain a copy.

Your rights

Subject to legal conditions, you may request access, rectification, erasure, restriction and portability, and object to processing based on legitimate interests. Where consent is used, you may withdraw it without affecting earlier lawful processing. Send requests to joaquimsilva@digitalcontrol.pt or the registered address. Proportionate identity verification may be required. We normally respond within one month; extensions for complex requests follow GDPR Article 12 and are notified within the first month.

Complaints and automated decisions

You may complain to Portugal’s supervisory authority, CNPD, at https://www.cnpd.pt, without first contacting us and without prejudice to other remedies. We do not carry out solely automated decisions, including profiling, producing legal or similarly significant effects.

Security and updates

We adopt technical and organisational measures proportionate to risk; Internet transmissions cannot be guaranteed risk-free. External links lead to services governed by their own policies. Please also read the Cookies Policy. Material changes will be reflected in this policy and its revision date.
